Basic information on data processing and legal basis

This privacy policy clarifies the nature, scope and purpose of the processing of personal data within our online offering and the websites, functions and content associated with it (hereinafter referred to as “online offering” or “website”).

The privacy policy applies regardless of the domains, systems, platforms and devices used on which the online offering is executed.‍ For the definitions of the terms used, such as “personal data” or their “processing”, we refer to Art. 4 of the General Data Protection Regulation (GDPR).

Types of data processed

We process various types of personal data when you use our website. This includes inventory data (e.g. personal master data, names or addresses), contact data (e.g. e-mail or telephone numbers), content data (e.g. text entries), usage data (e.g. websites visited, interest in content, access times), meta/communication data (e.g. device information, IP addresses) and server log data.

Collection of personal data when visiting our website

If you use the website for informational purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR):

Legal basis and duration of the processing of your personal data

‍Content data

If you send us inquiries by e-mail or via a service telephone, we process the information you provide in order to answer your inquiry and the date/time of the inquiry. The legal basis for the processing is our legitimate interest pursuant to Art. 6 (1) lit. f GDPR to provide you with the “Enquiries” service described above. If your request is aimed at the initiation or execution of a contract, the legal basis for the processing is Art. 6 (1) lit. b GDPR. Without this processing of your inquiry data, it is not possible to conclude or execute a contract. This data will be deleted when our communication with you has ended, i.e. when the matter in question has been conclusively clarified and there are no further legitimate interests or legal obligations to store it.

If you take part in one of our competitions, we will use your details (name, e-mail address) to carry out the competition, in particular to inform you and, if applicable, to send you a prize. Without the processing of your data, it is not possible to conclude the contract for participation in the competition and to carry it out. The legal basis for the processing is the contract for your participation in the competition (Art. 6 (1) lit. b GDPR). Your data will be deleted when the respective competition has ended and the prizes have been distributed. Your data will only be used for other purposes, e.g. advertising, if you have given your explicit consent.

If you have subscribed to one of our newsletters, we will process the data you have entered to send you the newsletter. The legal basis is your consent (Art. 6 (1) lit. a GDPR and (if you purchase similar goods or services from us and provide your e-mail address) our legitimate interests (Art. 6 (1) lit. f GDPR), possibly in conjunction with Section 7 (3) UWG). Your data will be deleted if you unsubscribe from our newsletter.

‍Usage data

We process the data collected when you use the website in order to inform you about modento services that may be of interest to you (advertising) or to improve our offers and services for you (product development). We use the anonymized or aggregated data obtained with the help of analysis tools to track the surfing behavior of all visitors and thus improve the design of our website and our offer. Details of the analysis tools can be found in the appendix. The legal basis for the processing is your consent (Art. 6 (1) lit. a GDPR) and our legitimate interests (Art. 6 (1) lit. f GDPR). This data will be deleted if you object to its use or if there is no longer a legitimate interest in storing it, in particular if you terminate your customer relationship with us.

‍The processing of server log data is necessary for technical reasons in order to provide the websites and services and then to ensure system security. The legal basis for the processing is our legitimate interest in providing the website with our services (Art. 6 (1) lit. f GDPR). Processing is absolutely necessary for the use of our website, so there is no right to object. This data is deleted immediately after the purpose for which it was originally stored no longer applies. The server log data may then be analyzed anonymously for statistical purposes and to improve the quality of our website. The server log data is not linked to your personal data or merged with other personal data sources.

Passing on the data

Transfer of data to processors

In some cases, we use service providers in compliance with legal requirements by way of order processing, i.e. on the basis of a contract on our behalf, in accordance with our instructions and under our control. Processors are in particular

  • technical service providers that we use to provide the website, e.g. service providers for data center operation and hosting
  • technical service providers that we use to provide functionalities, e.g. essential cookies,

In these cases, we remain responsible for data processing; the transfer and processing of personal data to or by our processors is based on the legal basis that allows us to process the data in each case. Data transfers abroad

The above-mentioned processors or other business partners may also include entities abroad. If these are entities in countries outside the European Economic Area that are not covered by an adequacy decision of the EU Commission, we ensure the protection of your personal data and the enforceability of your rights through appropriate safeguards (e.g. by means of data protection standard clauses issued or approved by the EU Commission). Data transfer to third parties

In some cases, we also transfer your data to third parties, i.e. partners with whom we work outside the scope of commissioned processing. Such partners provide their services as their own controllers; only their data protection notices apply to the processing of your data by partners.

What are cookies?

In order to make our websites as user-friendly as possible and to display personalized content, we and our partners use so-called cookies. How long are cookies stored?
